Refraction and transmission underwater

I'm attempting a scene using a half submerged figure. When rendering , the render shows the "underwater" part refracted as desired, but also shows an unrefracted image transmitted on top of it, which looks very strange indeed. I have tried tweaking all the settings but can't get rid of the transmitted image so only the refracted image is visible... I would really appreciate any pointers on this.
p.s. I know this might make me sound a bit of a dinosaur, but this is in DS3 using 3Dlight rendering - I dont have the hardware iray or the patience for DS4 ;).

Is this a render you can show? or redo with a clothed figure or a prop? Which shaders are being used, especially on the water surface?
Im using the built in shader preset for glass; I guess it is something to do with that shader becaiuse I can eleiminate the transmission using a very transparent plastic shader , but then the reflection looks a bit dodgy... Unfortunately I dont have a render, but I'll try to replicate the problem and post it. Thanks for taking the time!
