Hi, does anyone know what the license restrictions are when using Ron's Photoshop brushes? I'd like to use them to create advertising for a corporation, is this an acceptable use?
Comments
Which brush pack is in question
Well, all of them really. But I think the Splashes and the Waterline brushes right now.
The installation doesn't include anything from Ron other than tools and the DAZ installer's agreement is only about 3D. The DAZ terms of use page here on the site covers some mention of 2D but it kind of looks like it would be ok to use the artwork generated? As long as the actual brushes aren't put up the artwork is ok for advertising? Not too sure.
Each zip has a readme with the terms of use in it
I just said the installer didn't have any information. You must be busy.
The file I have is called 14690_RonsWaterline_1.0_gc.exe
it is an istaller.
It is an executable installation program, not a zip.
There aren't any zip files. You do have Ron's brushes so you know what you are talking about?
I've just checked every brush I've purchased and every one of them is an exe not a zip.
Update your files. Its a zip now. By the way I own all but 6 of his brush sets
Some copy and paste
Usage Tips or Limitations:
to use in your postwork renders for commercial and non commercial use.
You may use these as a merchant resource
NOT to resale as is Thats FINAL!
So please, please don't make copies, give them away or share. It affects me directly
It also breaks my heart to anyone might be getting my effort for nothing.
If you are a designer, you should know how it feels, too.
Enjoy the collection, but please respect my copyright!
Ron's brushes, well the older sets at least, did used to come in installers, as did all DAZ 3D content. However now DAZ 3D has provided the Download Manager (DIM) and all files come as zips, which can be downloaded using the DIM. Once the DIM is run there will be a link to the online Readme. This is the link to the one for the waterline brush set

Ty. That's the same one in a bunch of mine. Apparently he didn't have them in all his packs. The first 4 I checked did
Thank Endrance. I've seen that before somewhere and those are Deviney's words, so really appreciate that. Maybe it was at Deviant art?
Download the new zips and they are empty. No readme, no license nothing. He did do that and he's right here.
If you run the installer you will get an error if you aren't using Photoshop. Great. No Paintshop no gimp nothing. There are no other files in the zips, the two I downloaded, so the link probably returns to the license I mentioned way up there where Frank wasn't paying attention more.
Please remember the DAZ 3D forum TOS, general code of conduct, bullet points 2 and 4. Thankyou
In any event, using the content to generate finished 2D art work is covered by the basic DAZ 3D EULA - additional terms may relax the restrictions further, as with merchant resources, but should not place additional rstrictions unless those are noted on the product page, as with the Anne Marie Goddard Digital Clone (which is as far as I know the only exception).
Were those old installers? I've never had that problem. I do own Photoshop, but I never install my brushes to the Photoshop folder, so I know it's not looking for the program in my experience, anyway, and I own many of his brushes.
If you're installing with DIM, you can put whatever path you want in Applications for Photoshop.
Yes setting the path on the Applications page of the DIM fixed the error. Thank you.
After installing the brushes to the Photoshop folder with the DIM it can easily be seen the files are identical to the files from the older installation packages and also the same files in the zip. I.E. the Flames brushes package contains a readme which explains where to find the newly installed files, a tutorial in pdf format and the abr brushes. There is no where a link to any agreement or limiting license or either any notes from the artist regarding copyright or plagiarism.
In the EULA at http://www.daz3d.com/eula, in section 1.0 sub section E. Terms of Use, Two Dimensional Works, it says:
Subject to the terms and conditions of this Agreement, User may (i) access, use, copy and modify the Content in the creation and presentation of two-dimensional animations and renderings, (ii) incorporate two dimensional images (including two dimensional images that simulate motion of three dimensional objects) derived by User from the Content in User’s other works, and (iii) publish, market, distribute, transfer, sell or sublicense User’s two-dimensional animations, renderings and other works; provided that User may not in any case publish, market, distribute, transfer, sell or sublicense any renderings, animations, software applications, data or any other product from which any Content, or any part thereof, or any substantially similar version of the Content can be separately exported, extracted or de-compiled into any re-distributable form or format. All other rights with respect to the Content and its use are reserved by DAZ and its licensors.
Apparently "separately exported, extracted or de-compiled into any re-distributable form or format" is a judgment left to the owners of the copyright materials.
My apologies for any short tempered response in this thread. Your helpfulness and your time are indeed very much appreciated.
Thanks, have some fun. eom
