"Has someone been accused of copying someone else's work?"
The answer is yes. Many times. For example, several years ago a certain (formerly?) famous PA created a male figure. Another merchant started work on his own figure, using the same references. The original merchant erupted, declared his own work had been 'bodybagged", and while it was eventually proven to not be true, he had destroyed the other merchant's rep and product in the court of public opinion.
HOWEVER, that is an extreme example. For the most part, as long as one isn't REALLY a copy of the other (as in same mesh, textures, directly ripped off, etc), then there'll not likely be much of an issue.
Okay, I have been interested in this myself. Once upon a time, lots of people were making things for Poser. There were lots of freebies. People were downloading the files illegally, lots of people. The merchants and freebie creators decided it should look like the wild wild west and wanted to stop the gross violations. One merchant who shall not be named was working with a partner to create skin textures for characters. Her partner layered in some skin from textures that were not merchant resources. It was discovered and her reputation was ruined after years of building it up threw freebies. Another person download items and textures that were free to use non commercially and edited them and released them in a commercial product. Banned, all banned from the market place at Renderosity years ago. Many freebie artists would edit a commercial product or make a derivative work form it and try to release it as a freebie. Good way to get into trouble that was. A person would post a picture of Vicky whoever wearing a limited edition pair of boots the boot maker had no record of them ever purchasing. Banned!
Wendy you so far away from the this type of behavior it hurts. People can look at a mess or texture and usually determine if it is original and does not use their model as a base or parts of it. There were applications to check textures for matches and in some case where they used the same textures to make a brush you'd hit a false positive. But by in large, the community is not after honest people working hard and doing their own thing. Also even when someone was doing terrible things, the artists didn't have the time or money to take them to court. But they would be banned, shunned and made to feel quite awful about what they had done.
Its an excellent idea to learn how to save evidence of your work and verify the originality of it. And in the past the question was did you model it? Did you make that texture or use market resources as you should? Not "you stole my idea!" A fashion designer couldn't make anything if things like cowl necks could be considered the exclusive domain of one particular designer. I don't recall anybody ever having a hissy fit over an originally modeled tank top just because one was available to buy in the store already. They were mostly concerned that people were not cheesy and were doing their own work.
You know just thinking about one thing about my past. When I was young before the internet really came into the social network it is. We use to do meetings and trade soft numbers with others (I'm talking 20 to 25 years ago). It was mainly Atari after the first disk drives made it possible to copy things. The first wave of a bunch of smart kids wanting to get the most out of what little moneys they had. That went on in my life till about 15 years ago when I drove my car into a pole after a DUI in order to start my real life of hard work as an eventual tire changer. About 5 years ago I started to purchase Poser, Vue, Cararra, UVmapper, etc. I always liked Daz figures and know a lot about them from my past. Bought Daz Studio 3 ADV. at a Club price Upgraded to 4 (payed for that too). Bought and am buying lots of stuff at all the 3D stores. Then all of a sudden Daz says that Daz Studio Pro 4 was going to be a free for all.....
That has never bothered me because of who I used to be. Funny thing I never tried to make money off what 3D I do now that I am a paying customer. But When they made Studio free I just hoped that some of the younger people out there would try it out. Because had I not been who I was I wouldn't have done 3D. 3D Maxed out the price like a couple of $1000 dollars back when it was something I was interested in.....never learned that anyway. I did learn then bought Poser. New Tech is a definite buy for me now and Daz is at the top of that with their character creation software. Waiting to buy the HD creation stuff. Call it the college of a poor kid. Still don't make a lot now, but at least daz has some smart people at the helm. I don't need or like to beta test for them I just wish new tech would come out faster for the general public so I could buy it. I can imagine that copyrights hold back Daz sometimes. Sub D Cat? Just make the money back then give it to them maybe? think of the money we will make on the Characters.....
Well I hope they keep doing it. And that's also my view on copyrights, Mister Lukas Can I at least see the movie so I can know what is possible? I'd like to fly the flying saucers!!!!!
Yeah, in retraining the customers, lots decided they couldn't afford to do it all legally. Daz Studio being free and all the sales here make it possible for me to be an honest person. I think maybe more merchant resources being available helps people decide to create more things. But I don't think the community is out to punish people who make their own stuff like Wendy did. She made hers herself so it shouldn't matter that someone made and sells a better one. I think with museum pictures of items being available, you are gonna get two chalices occasionally. In a situation like that, if you can show you wanted to make that item and did it yourself, you should be fine. How many cups are out there? How many mini skirt models are out there?? Just because its an uncommon item shouldn't mean only one person has a right to build it. She should be able to build anything that isn't trademarked like a model of car or mickey mouse without anyone fussing.
Most of issues at the various brokers over the years have been related to textures.
Claims are handled on a case by case basis by the brokerages that are involved.
